These Terms and Conditions ("Terms") govern your access to and use of the Services provided by Tenta.id ("Company", "we", "us", or "our"). By registering, accessing, or using our platform, you ("User") agree to be legally bound by these Terms. If you do not agree, you must immediately cease all use of the Services.

1. Definitions

  • "Services" means all digital products, software platforms, AI agents, automation tools, integrations, APIs, and related features provided by Tenta.id.
  • "User" means any individual or legal entity that registers for or uses the Services.
  • "Credits" means the prepaid units purchased by the User and consumed per agent action on the platform.
  • "Agent Action" means any automated or human-assisted action performed through the platform, including but not limited to sending messages, executing AI responses, and triggering automation flows.
  • "Channels" means the communication platforms integrated with Tenta.id, including WhatsApp, Instagram, Messenger, Telegram, Email, SMS, and Live Chat.
  • "Content" means any text, images, files, data, or other materials uploaded, transmitted, or processed through the Services.

2. Eligibility

  • You must be at least 18 years of age to use the Services.
  • If registering on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.
  • The Services are intended for lawful business purposes, primarily for small and medium enterprises (UMKM) operating in Indonesia and internationally.
  • Tenta.id reserves the right to refuse service to anyone at its sole discretion.

3. Account Registration

  • You must provide accurate, complete, and up-to-date information during registration.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You must notify Tenta.id immediately of any unauthorized access or suspected security breach of your account.
  • You may not share, sell, or transfer your account to any third party without prior written consent from Tenta.id.
  • Tenta.id is not liable for any loss or damage arising from unauthorized access due to your failure to secure your credentials.

4. Credits, Top-Up & Billing

Tenta.id operates on a prepaid credit system — there are no monthly subscriptions. Users purchase Credits in advance and Credits are deducted per Agent Action performed on the platform, whether by AI agents or human agents.

Credit System Overview

  • Credits are purchased via top-up and are valid for use on the Tenta.id platform.
  • Credits are deducted per Agent Action — including AI-generated replies, human agent responses, automation triggers, and channel interactions.
  • Credit deduction rates may vary by action type and channel. Refer to the pricing page for current rates.
  • Credits are non-refundable once consumed.
  • Unused Credits do not expire as long as the account remains active.
  • Top-up transactions are processed through third-party payment providers. Tenta.id does not store sensitive payment card data.
  • In the event of a failed transaction, Credits will not be credited until payment is confirmed.
  • Tenta.id reserves the right to modify Credit pricing and deduction rates with prior notice to Users.
  • Refund requests for unused Credits must be submitted within 30 days of purchase and are subject to review.

5. Acceptable Use

You agree not to use the Services to:

  • Send spam, unsolicited bulk messages, or conduct mass harassment campaigns.
  • Distribute malware, phishing content, or any harmful code.
  • Violate applicable laws, regulations, or third-party platform policies (including Meta, Telegram, and other channel providers).
  • Infringe upon intellectual property rights of any party.
  • Engage in fraudulent, deceptive, or misleading communications.
  • Attempt to reverse engineer, disassemble, or exploit the platform's infrastructure.
  • Access or scrape data from Tenta.id beyond what is permitted by these Terms or the API documentation.

Violation of this section may result in immediate suspension or termination of your account without refund.

6. User Obligations

  • You are responsible for all Content transmitted through your account.
  • You must ensure that your use of the Services complies with all applicable laws, including but not limited to Indonesia's Electronic Information and Transactions Law (UU ITE), Personal Data Protection Law (UU PDP), and Consumer Protection Law.
  • You are responsible for obtaining all necessary consents from your customers before processing their data through Tenta.id.
  • You must not misrepresent your identity or affiliation when using the Services.
  • You must comply with the terms of service of all integrated third-party platforms (e.g., WhatsApp Business API Terms, Meta Platform Policy).

7. Tenta.id Rights & Obligations

7.1 Our Rights

  • To monitor platform usage for security, compliance, and service quality purposes.
  • To suspend or terminate accounts that violate these Terms.
  • To modify, update, or discontinue any feature of the Services with reasonable notice.
  • To introduce new pricing, Credit rates, or billing structures with prior notification.

7.2 Our Obligations

  • To use commercially reasonable efforts to maintain platform availability and performance.
  • To notify Users of planned maintenance or significant service changes in advance.
  • To protect User data in accordance with our Privacy Policy.
  • To provide support channels for Users to report issues and submit inquiries.

8. Intellectual Property

  • All intellectual property rights in the Services, including software, trademarks, logos, and documentation, remain the exclusive property of Tenta.id.
  • Users retain ownership of their own Content uploaded to the platform.
  • By uploading Content, you grant Tenta.id a limited, non-exclusive license to process and display that Content solely for the purpose of providing the Services.
  • You may not reproduce, copy, modify, or distribute any part of the Services without prior written consent from Tenta.id.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Tenta.id shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
  • Tenta.id's total liability for any claim shall not exceed the total Credits purchased by the User in the 30 days preceding the claim.
  • Tenta.id is not liable for damages caused by third-party platform outages, API changes, or policy updates by channel providers.
  • Tenta.id is not liable for losses arising from unauthorized access to your account due to your failure to secure credentials.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

10. Service Changes & Downtime

  • Tenta.id may update, modify, or temporarily suspend the Services for maintenance, upgrades, or operational reasons.
  • Planned maintenance will be communicated in advance where reasonably possible.
  • Tenta.id does not guarantee uninterrupted availability and is not liable for service interruptions caused by force majeure, infrastructure failures, or third-party outages.
  • Credits will not be automatically refunded for downtime unless Tenta.id determines compensation is appropriate at its sole discretion.

11. Account Termination

11.1 Termination by User

You may terminate your account at any time by submitting a written request to our support team. Upon termination, your access will be revoked and data will be retained per our Privacy Policy.

11.2 Termination by Tenta.id

  • Tenta.id may suspend or terminate your account immediately for violations of these Terms, fraudulent activity, or non-compliance with applicable laws.
  • In cases of serious violations, no refund of remaining Credits will be provided.

11.3 Effect of Termination

  • Upon termination, your right to use the Services immediately ceases.
  • Any remaining Credits at the time of termination may be forfeited unless a refund is approved.
  • Provisions of these Terms that by their nature should survive termination will remain in effect.

12. Governing Law & Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia.
  • Any disputes arising from or relating to these Terms shall first be resolved through good-faith negotiation between the parties.
  • If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration or the competent courts in Medan, North Sumatra, Indonesia.
  • Nothing in this section prevents either party from seeking urgent injunctive relief from a competent court.
